Borough Council will hold a public hearing and will consider the adoption of ordinances amending the Conshohocken Zoning Ordinance as set forth below, at 7:00 PM on Wednesday, April 6, 2022, in Borough Hall, located at 400 Fayette Street, Conshohocken, PA 19428.

In accordance with the requirements of the Pennsylvania Municipalities Planning Code, the following is a summary of the proposed ordinances:

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY  COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING THE CODE OF ORDINANCES OF THE BOROUGH OF CONSHOHOCKEN, CHAPTER 27 ZONING, PART 15 SP-1 AND SP-2 – SPECIALLY PLANNED DISTRICTS ONE AND TWO, PART 16 SP-3 – SPECIALLY PLANNED DISTRICT THREE, AND PART 22 SP-4 – SPECIALLY PLANNED DISTRICT FOUR TO REMOVE RESIDENTIAL USES FROM THE SP-1, SP-2, SP-3, AND SP-4 ZONING DISTRICTS; REPEALING PRIOR INCONSISTENT ORDINANCES OR PART OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE.

The ordinance amends the Borough’s Zoning Ordinance by removing residential uses from the uses permitted in the Borough’s Specially Planned Districts at Part 15 SP-1 and SP-2 – Specially Planned Districts One and Two, Part 16 SP-3 – Specially Planned District Three, and Part 22 SP-4 – Specially Planned District Four of the Zoning Ordinance. 

The ordinance amends the Declaration of Legislative Intent (§27-1501), Use Regulations (§27-1502)  and Dimensional Design Standards (§27-1511) of Part 15 SP-1 and SP-2 – Specially Planned Districts One and Two to remove the provisions related to, and standards for, residential uses therein.

The ordinance amends the Declaration of Legislative Intent (§27-1601), Use Regulations (§27-1602), and Conditional Use (§27-1603 and §27-1604) provisions and standards of Part 16 SP-3 – Specially Planned District Three to remove the provisions related to, and standards for, residential uses therein.

The ordinance amends the Use Regulations (§27-2202) provisions related to Unified Developments and the parking regulations (§27-2206), of Part 22 SP-4 – Specially Planned Districts Four to remove the provisions related to, and standards for, residential uses therein.

The ordinance contains a severability clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.

Removal of Residential Uses in SP Zoning Districts

AN ORDINANCE OF THE BOROUGH OF CONSHOHOCKEN, MONTGOMERY COUNTY, COMMONWEALTH OF PENNSYLVANIA, AMENDING THE BOROUGH OF CONSHOHOCKEN ZONING ORDINANCE OF 2001 BY CHANGING THE REQUIRED NOTICE REQUIREMENTS AND PROCEDURES OF THE ORDINANCE WITH RESPECT TO HEARINGS UNDER THE ORDINANCE; AMENDING THE PROVISIONS RELATING TO EXPIRATION OF ZONING VARIANCES AND SPECIAL EXCEPTIONS AND ADDING AN EXPIRATION PERIOD FOR CONDITIONAL USES; CONFIRMING THAT CERTAIN PROVISIONS OF PART 12 R-O RESIDENTIAL OFFICE DISTRICT ARE NO LONGER OF ANY FORCE OF OTHER EFFECT; REPEALING PRIOR INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

The ordinance amends the Borough’s Zoning Ordinance by amending the Zoning Ordinance’s provisions related to mailed notice of zoning hearings, found at Part 6 Zoning Hearing Board.  The ordinance reduces the range of required notice from 500 feet of the subject property to 250 of the subject property.  The ordinance also specifies that the Borough will compile the relevant owner/contact information regarding properties within 250 feet of the subject property and send the notices, with the cost of same being paid by the applicant.  The ordinance also amends Part 6 Zoning Hearing Board and Part 8 General Regulations by amending the expiration period for zoning relief by increasing the expiration period from 6 months to 1 year.  Under the amendment, special exceptions, variances, and conditional uses expire after 1 year if the applicant fails to obtain any and all permits within that time period.  The ordinance addresses removal of certain invalidated provisions from Part 12 R-O Residential Office District from the codification of the Zoning Ordinance, specifically removal of section 27-1202.5.   The ordinance contains a severability clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.
